Terms and conditions

Welcome to Duncraig Sauna and Soak facility. Here at Duncraig Sauna and Soak, it is our focus to ensure the safety and wellbeing of all patrons and staff attending this facility. By understanding, agreeing and abiding with these conditions you help to ensure a safe environment not only for yourself but also other staff and patrons. We advise you only sign this agreement if you agree to abide by these terms and conditions. In the event of a discrepancy, the information outlined in these terms and conditions can and will be used.

1. Introduction

By signing/agreeing to this Agreement/Terms and Conditions, you understand and agree to the following:

(a) You have a copy of this agreement

(b) All patrons must obey/abide with all outlined obligations in this agreement

(d) You do not have any medical conditions that stop you from undertaking any normal course of sauna and ice bath. If you have any medical conditions which may affect your ability to participate, you need to provide a medical note from your doctor, dated and signed, before participating in any of our services to say that you are fit to attend sauna and ice bath; and

(e) You are aware that there is a level of risk participating in sauna and ice bath and using our equipment may pose a risk to your health, and you use our facilities at your own sole risk.

2. Definitions

· “Agreement” refers to the entire document that makes up your agreement to use the facilities of the Duncraig Sauna and Soak which are outlined in the terms and Conditions Agreement

· “Terms” and “Conditions” refers to Terms and Conditions you must abide by in the Agreement

· Duncraig Sauna and Soak is the trading name for Duncraig Sauna and Soak, which all contracts are legally bound to.

· “You” and “Patrons” refers to who is reading these terms and conditions to allow them to legally enter Duncraig Sauna and Soak.

· “Facility, Premises, Hub, Location” is referred to the place in which this agreement allows you to access Duncraig Sauna and Soak.

3. Patron Agreement

We acknowledge the following:

(a) Duncraig Sauna and Soak opening hours are updated regularly and can be found on the website.

(b) Public Holidays: Closed on Public Holidays unless specified otherwise on the website

(c) Opening hours my change or vary from time to time. Duncraig Sauna and Soak reserves the right to change operating hours. Any changes will be updated on our website.

(d) You enter the Duncraig Sauna and Soak at your own risk. You’ll receive an induction on your first visit to familiarise yourself with the premises.

(e) You may only use the facilities outlined in the agreement, that is the outside shower, sauna and ice bath. The swimming pool IS NOT TO BE ACCESSED by patrons.

(f) Patrons are not to access the property without making an appointment via the website of Duncraig Sauna and Soak and paid the fees.

3.1 Refusal of Entry

You may be refused entry or requested to cease activity and the leave the premises as a result of the following conditions:

· Unpaid or outstanding fees

· You are under the influence of drugs or/and alcohol

· Smoking or vaping on the Duncraig Sauna and Soak premises

· You are behaving in a threatening way or using threatening or abusive language

· Bullying or discriminating against other patrons or staff

· Wearing offensive or inappropriate clothing

· Using sauna without a large enough towel that rests under body and feet

· Interfering or causing trouble

· Inappropriate use of the facilities

3.2 Illegal Activity

At Duncraig Sauna and Soak we do not tolerate any illegal activities on our premises. We have the right to call the police and terminate your use of the facilities immediately we catch you participating in these events.

3.3 Age policy

(a) All minors must be accompanied by their legal guardian at a ratio of 1:1 and must be over 14 years of age. All minors are expected to obey all safety instructions. Legal guardians of minors will be held to account under these terms and conditions, for inappropriate behaviour by minors.

4. Induction Policy

· You will be greeted upon arrival at your first session

· You will be shown how to operate the sauna touch screen to adjust temperature

· You will be shown the outdoor shower which provides a private space to change

· You will be reminded to shower prior to entering the ice bath

· You will be given the opportunity to ask questions of Edward and Jessica to enhance your experience at Duncraig Sauna and Soak

5. Photography

(a) For privacy, patrons are not permitted to film or photograph anyone on the Duncraig Sauna and Soak premises who is not in their party, including the family who live at 27 Cimbrook Way, Duncraig, without their written permission. You may take photos or videos of yourself at Duncraig Sauna and Soak within the premises while using the facilities and post this to social media if you wish.

(b) By agreeing to this Agreement, you are allowing us to use non-specific/identifiable images or videos captured in our premises that may be in the background for promotional related content on social media or other marketing sources. If the person can be identified, we’ll seek written permission.

6. Use of Ice Bath and Sauna

(a) To ensure the safety of yourself and others you must follow all instructions on the equipment and use for its intended purpose(s).

(b) If you are unsure how to correctly and safely operate the equipment, please read and follow the instructions on the equipment. You may also call Jessica on 0405349196 for further instruction.

(d) You must supply your own towel and toiletries. You will require 2 towels, one for using to sit on while in the sauna and one for drying yourself following the ice bath/shower prior to your departure

(e) You must use a clean towel while using sauna to sit/lean on and wipe down after use.

7. Yoga/Ice bath and Sauna Sessions

(a) A total of 10 participants with their babies will be the maximum allowed per class

(b) You will be responsible for caring for your own baby

(d) There will be no child care or childcare facilities provided

(e) You are able to bring a support person to care for the baby for the duration of the session if you would like to

(d) You are to provide your own yoga mat for the session

8. Valuables and Liability of Property

(a) You are responsible for all personal items while on the property

(b) Duncraig Sauna and Soak is not liable for any loss or damage to personal property within the facility

(d) Duncraig Sauna and Soak staff will not look after your personal items while you are on the premises

(e) We will not be liable for any damage or theft to your vehicles, or its contents while parked outside the Duncraig Sauna and Soak

9. CCTV

(a) By signing this Agreement, you acknowledge that you may be under video surveillance whilst in or around the facility. Security cameras are located over the premises for security purposes. This footage will be stored and used as evidence in the event of any breach or misconduct outlined in this Agreement or an external breach

(b) You give consent to being filmed under video surveillance for the above purposes

10. Personal Injury and Damage

Whilst on the premises of Duncraig Sauna and Soak facility to the extent permitted by the law, Duncraig Sauna and Soak is not liable for any patron, in Agreement, tort, statute or for any injury, damage or loss of any kind, including any liability for direct or indirect loss or damage including death, sustained by the patron or their minors, or any other person, or for any costs associated or caused by the patrons attending this facility, or any services or products provided by Duncraig Sauna and Soak.

You must provide written medical approval, written, signed and dated in the last 4 weeks, if you have any medical condition for which use of sauna and/or ice baths isn’t recommended. This includes but not limited to, pregnancy. Cardiovascular disease (heart disease), heart arrhythmia (irregular heart beat), anorexia, cold urticaria, hypotension (low blood pressure), hypertension) high blood pressure), insensitivity to heat, inflammatory skin conditions or certain pharmaceutical medications.

Duncraig Sauna and Soak accepts no responsibility to injury while on the premises including while carrying out yoga on the premises.

11. Bookings and Cancellations

(a) All sessions must be booked via our website to ensure you have reserved access to the session and you wish to attend. You cannot attend a session if a booking has not been made in advance.

(b) Duncraig Sauna and Soak does not guarantee availability for any sessions if a Booking hasn’t been made in advance.

(c) If you are booked into a session and wish to cancel, you must cancel through our website at least 48 hours prior to the session time commencement:

· If you cancel with more than 48 hours notice we will reschedule your appointment for free

· If you cancel with less than 48 hours notice, you will lose the ability to reschedule for free.

· You will be charged the full fee for no shows and non-cancellation.

All sessions and costs are visible and updated on our website

12.Health and Medical Safety

Infrared sauna use may not be suitable for everyone. You must follow the health guidelines within these Terms and Conditions.

· Do not use if you are pregnant or under the influence of drugs and/or alcohol, or are feeling unwell

Consult your doctor before use if you:

· Take medication affecting the heart, heart rate, blood pressure, circulation or alertness

· Have any chronic health conditions (e.g. heart disease, diabetes, circulatory issues etc)

· If you have any underlying health conditions, it is your responsibility to consult your doctor prior to using the infrared sauna.

· Allow your body to cool down after exercise before entering the sauna

· Remove all jewellery before your session

· Never sleep inside the sauna

· Enter and exit with care-heat may affect coordination

13.Hygiene and Etiquette

To ensure safety and cleanliness for all users:

· Bring two clean towels: one to sit on in the sauna and one to dry yourself after the shower/ice bath

· Wear appropriate swim wear or active wear

· Do not apply oils, lotions or anybody products before entering

· Avoid contact with infra-red lamps or heaters

· Dry off before entering the sauna

· Wipe down sweat or spills after your session

· Keep noise to a reasonable or minimum level. You are able to play music in this space as long as it is at a reasonable volume.

14.Damage, Behaviour and Access

· Users are financially liable for any damage caused by misuse or negligence

· Disrespectful or unsafe behaviour will result in an immediate removal without refund

· You may only access the facility during your booked session time

· Please exit promptly following at the end of your session to allow the next booking to begin on time.
